4. Shipping Terms

4.1 Prohibited Items

You agree not to ship items that are:

  • Hazardous materials (unless properly declared and packaged)
  • Perishable goods (without appropriate services)
  • Items of extraordinary value without declared value coverage
  • Counterfeit or pirated goods

4.2 Packaging Requirements

Shippers are responsible for properly packaging items to withstand normal handling during transit. Gone Shipping is not liable for damage resulting from inadequate packaging.

4.3 Delivery

Delivery times are estimates and not guarantees unless explicitly stated for time-definite services. Delays may occur due to weather, customs, or other factors beyond our control.

5. Payment Terms

You agree to pay all shipping charges, fees, and applicable taxes associated with your use of our Services. Payment is due at the time of shipping unless you have an approved credit account with Gone Shipping.

We reserve the right to:

  • Adjust charges if package dimensions or weight differ from declared values
  • Charge for address corrections or re-delivery attempts
  • Hold packages until outstanding balances are paid

6. Liability Limitations

6.1 Service Liability

Gone Shipping's liability for loss, damage, or delay is limited to:

  • The declared value of the shipment, or
  • $100 USD per package (whichever is less), unless additional coverage is purchased

6.2 Exclusions

Gone Shipping is not liable for:

  • Consequential, special, or indirect damages
  • Loss of profits or business opportunities
  • Delays caused by force majeure events
  • Damage to improperly packaged items
  • Items prohibited from shipment

7. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Gone Shipping or its licensors and is protected by intellectual property laws. You may not:

  • Copy, modify, or distribute our content without permission
  • Use our trademarks without written authorization
  • Reverse engineer our software or systems

8. Privacy

Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Indemnification

You agree to indemnify and hold harmless Gone Shipping, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Items you ship through our Services

10. Dispute Resolution

10.1 Claims

Claims for loss or damage must be submitted within 21 days of delivery (or expected delivery for lost packages). Claims should be filed through our customer service portal or by contacting our claims department.

10.2 Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.

10.3 Arbitration

Any disputes arising from these Terms shall be resolved through binding arbitration in New York, NY, in accordance with the rules of the American Arbitration Association.

11. Modifications to Terms

Gone Shipping reserves the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of our Services after changes are posted constitutes acceptance of the modified Terms.

12. Termination

Gone Shipping may terminate or suspend your access to our Services at any time, with or without cause, with or without notice. Upon termination, your right to use our Services will immediately cease.
